I percorsi migratori e la pandemia. Come cambiano le emergenze

Abstract: A partire dalla restrizione dei viaggi non essenziali verso l’UE nei confronti dei cittadini stranieri il saggio analizza due momenti che caratterizzano il percorso migratorio, l’inizio e la fine, attraverso le figure dei richiedenti asilo alla ricerca di un luogo sicuro e degli stranieri in attesa di rimpatrio, nel corso della pandemia. Le due vicende sono sintomatiche di una sovrapposizione tra emergenze, quella (contingente) sanitaria che si accompagna alle criticità ordinarie della c.d. politica dei “porti chiusi” e della “galera amministrativa”. Più precisamente, si analizzerà l’impatto del decreto interministeriale del 7 aprile 2020 che ha dichiarato non sicuri i porti italiani per i migranti soccorsi da navi battenti bandiera straniera e fuori dell’area SAR italiana, per tutta la durata dell’emergenza nazionale, sui diritti dei naufraghi, quali il diritto a raggiungere un posto sicuro, il diritto d’asilo e il diritto alla salute. Si valuterà poi la compatibilità di tali diritti con la soluzione delle cosiddette “navi quarantena”, attraverso alcune importanti decisioni, passate e recenti, della giurisprudenza interna e della Corte EDU. Con riferimento alla restrizione della libertà personale dei cittadini stranieri in attesa di essere rimpatriati, uno spunto di riflessione sull’art. 15 della direttiva 2008/115/CE è offerto dal caso spagnolo e dallo svuotamento temporaneo dei CIEs.

Abstract: Starting from the restriction of non-essential travel to the EU for non-EU citizens this work will analyse two typical moments of the migration route, the beginning and its end, through the figures of asylum seekers looking for a safety place and immigrants awaiting deportation, during the pandemic. The two events are symptomatic of an overlap between emergencies, the (contingent) healthy one, that accompanies the ordinary criticalities of the so-called policy of “closed ports”, and “administrative jail”. More precisely, it will analyse the impact of the interministerial decree of 7 April 2020 which declared the Italian ports unsafe for migrants rescued by ships flying a foreign flag and outside the Italian SAR area, for the entire duration of the national emergency, on rights of the rescued persons, such as the right to a Place of Safaty, the right of asylum and the right to health. The compatibility of these rights with the solution of the “quarantine ships”, will be studied starting from some important decisions, past and recent, of the internal jurisprudence and of the EDU Court. Regarding the restricting freedom to foreigner citizens in order to prepare their deportation, the opportunity to reflect on the art. 15 Directive 2008/115/EC is offered by the story of the temporary emptying of the Spanish CIEs.
